1. Two‑Stage Engagement

We never enter a full project without first understanding whether we can genuinely add value. Therefore, our work is divided into two separate stages, each with its own agreement.
 

Stage 1 – Discovery Agreement: Initial meetings (Milestones 1‑3) to explore your unfinished business, cultural capital, and the potential for an enduring legacy. No commitment to proceed further.

Stage 2 – Project Execution Agreement: Detailed design and execution of your personalised legacy project (Milestones 4‑7), including the “Guidebook”, timeline, costs, and delivery.

You are never locked in. Stage 1 creates no obligation to enter Stage 2. We will tell you honestly if we believe we cannot create value for you.
 

2. Confidentiality (NDA)

All information shared – whether by you, your Family Office, or MONARIQE – is protected by a mutual Non‑Disclosure Agreement (NDA) signed before any discovery meeting.

• Duration of confidentiality: 5 years after the end of our engagement (trade secrets indefinitely).

• Exceptions: Information that becomes public through no fault of either party, or that is required by law (e.g., a court order in the UAE).

• No storage on our website: We do not store any personal information on our website. Notes from our conversations are kept encrypted and deleted after the project is completed, unless a longer retention is required by law or agreed in writing.

3. Intellectual Property – The Legacy Is Yours

Any final work created for you – a book, artwork, documentary, charitable foundation, or any other form of enduring legacy – is solely owned by you. MONARIQE claims no intellectual property rights over your legacy.

Our role is that of a facilitator and companion. You are the creator.

4. No Legal or Financial Advice

MONARIQE does not provide legal, financial, or estate planning advice. Nothing on our website or in our discussions replaces professional advice from qualified lawyers, accountants, or wealth managers. We strongly encourage you to consult such professionals, especially for matters relating to inheritance, tax, and binding legal documents.

5. Fees & Payments

• Stage 1 (Discovery): Fixed fee, payable before the first discovery session. This fee is non‑refundable, as it covers our time and expertise in assessing your case.

• Stage 2 (Execution): Custom pricing based on the personalised project plan. A detailed cost breakdown is provided in the “Guidebook” before you sign the Project Execution Agreement. Payment milestones are clearly defined in that agreement.

All fees are agreed in writing with your Family Office (or directly with you, in the rare case you do not use a Family Office).

6. Governing Law & Jurisdiction

All agreements are governed by the laws of the United Arab Emirates. Any dispute arising from our engagement shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.

7. The Role of Your Family Office

• If you have a Family Office: All formal agreements (NDA, Discovery Agreement, Project Execution Agreement) are signed between MONARIQE and your Family Office, acting on your behalf. Your Family Office remains your legal representative and is responsible for your identification, KYC, and compliance with applicable laws.

• If you do not have a Family Office: We can introduce you to a trusted Family Office partner in your country. That Family Office will then act as your representative under the same model. Direct engagement with MONARIQE without a Family Office is possible only under exceptional circumstances and with additional safeguards.

8. Entire Agreement & Modifications

Each written agreement (together with its attachments) constitutes the entire understanding between the parties for that stage. Any modification must be in writing and signed by both parties.

9. Availability of Full Legal Documents

We do not publish our full agreements on this website, because every engagement is personalised. However, serious inquirers may request the relevant template documents through their Family Office. Once a preliminary assessment is complete, we will provide the full text of the NDA, Discovery Agreement, and Project Execution Agreement for your (and your Family Office’s) review.
